With all of this, I can agree.However, whereas we share the goal of transformative music education through aesthetic experience, we differ in the means by which we would accomplish our goal and we differ for philosophical reasons. Kertz-Wezel promotes an approach to music experience that celebrates individuality and a return to Romanticism.2 By contrast, I have developed an approach to music experience that depends on collaborative music-making and that emphasizes the social and interpersonal context, as opposed to the individual. I would like to describe how my approach, contrary to the individualistic approach espoused by Kertz-Wezel, nevertheless accomplishes the goal of transformative music education.My approach is grounded in principles abstracted from the writings of John Dewey.3 Like Dewey, I believe that the only true education comes through the stimulation of an individual's powers by the demands of the social situations in which individuals find themselves.4 Therefore, in the schools that serve as field and research sites for our university, we create communities of musical practice in which individuals gain the full and ready use of all their capacities while performing newly composed art music.5 Every year a set of new works are composed especially for our students by composers at our university. Through the process of actualizing a piece of art, our students are "stimulated to act as member(s) of a unity, to emerge from (their) narrowness of action and feeling, to conceive of (themselves) from the standpoint of the welfare of the group to which (they) belong."6 The image of a fully engaged community member stands in stark contrast to that of the young woman in Kertz-Wezel's paper who, in describing her experience at the rock concert, said, "You don't think about what you are doing. You do what you feel like, without even thinking about it." When in a trance, individuals are detached from, not connected to, their physical surroundings.7 When in a state of ecstasy, individuals are carried beyond rational thought and self-control.8 It is impossible for me to imagine how an individual in a state of semi-conscious detachment, lacking in rational thought and self-control, can be learning.9Students in communities of musical practice are fully conscious of the value that they have to the group and "the value is reflected back into them."10 They learn to listen intently to other performers within the ensemble. They learn to communicate with one another in the symbol system of music and their musical babblings are transformed into articulate language.11 They become literate when they actualize into musical art what is embedded in the abstract symbols in a score. They have the kind of aesthetic experience described by Dewey:The material of esthetic experience in being human—human in connection with the nature of which it is a part—is social. “Nihilism” (from the Latin “nihil” meaning nothing) is not a well-defined term. One can be a nihilist about just about anything: A philosopher who does not believe in the existence of knowledge, for example, might be called an “epistemological nihilist”; an atheist might be called a “religious nihilist.” In the vicinity of ethics, one should take care to distinguish moral nihilism from political nihilism and from existential nihilism. These last two will be briefly discussed below, only with the aim of (...) clarifying our topic: moral nihilism. Even restricting attention to “moral nihilism,” matters remain indeterminate. Its most prominent usage in the field of metaethics treats it as a synonym for “error theory,” therefore an entry that said only “Nihilism: see ERROR THEORY” would not be badly misleading. This would identify moral nihilism as the metaethical view that moral discourse consists of assertions that systematically fail to secure the truth. (See Mackie 1977; Joyce 2001.) A broader definition of “nihilism” would be “the view that there are no moral facts.” This is broader because it covers not only the error theory but also noncognitivism (see NONCOGNITIVISM). Both these theories deny that there are moral facts—the difference being that the error theorist thinks that in making moral judgments we try to state facts (but fail to do so, because there are no facts of the type in question), whereas the noncognitivist thinks that in making moral judgments we do not even try to state facts (because, for example, these judgments are really veiled commands or expressions of desire). Scientists have been arguing for more than 25 years about whether it is a good idea to collect voucher specimens from particularly vulnerable biological populations. Some think that, obviously, scientists should not be harvesting organisms from, for instance, critically endangered species. Others think that, obviously, it is the special job of scientists to collect precisely such information before any chance of retrieving it is forever lost. The character, extent, longevity, and span of the ongoing disagreement indicates that this is likely (...) to be a hard problem to solve. Nonetheless, the aim of this paper is to help field biologists figure out what do to when collecting a voucher specimen risks extinction. Here I present and assess varying practices of specimen collection for both extant and extinct species in order to compare and contrast cases where extinction risk both is and is not a problem. When it comes to taking vouchers from extant species at some risk of extinction, I determine that those advocating for conservative approaches to collection as well as those advocating for liberal information-gathering practices have good reasons to assess things in the way they each do. This means that there is unlikely to be a decisive, one-size-fits-all response to this problem. Still, progress can be made. We can acknowledge the risks of proceeding in either manner, as well as the uncertainty about how best to proceed. We can proceed as thoughtfully as possible, and be ready to articulate a rationale for whichever procedure is used in any particular case. (shrink)

This paper investigates the relationship that people with high functioning autism have with organizational temporality by considering this operationalization within the framework of humanistic management. To do so, it proposes an analysis based on seven propositions. Autism is a disorder that is still poorly understood and often linked to social depictions that are as unfounded as they are repulsive. It remains an unexplored area of study in the field of management sciences. Existing scholarship has established that people with autism (...) have great difficulty finding and retaining employment. While it is well known that they have weak social skills, their difficulties in relation to time have only been studied in medical research, even though organizational temporality substantially shapes the functioning of teams. The operationalization of autistic temporality as a particular temporality within humanistic management allows for the development of a new conceptual framework based on a consideration of neuro-atypia. This paper begins with a presentation of the theoretical background. It then develops the theoretical model. Although ever-increasing numbers of women in the United States have been choosing small-business ownership in an apparent attempt to escape their well-documented inequality in the labor market, in this country, small businesses owned by women tend to be less successful than those owned by men. This article brings together the scattered pieces of data available in order to shed light on women's inability to gain greater parity with men in the small-business arena in the United States. Analysis suggests that U.S. (...) women's influx into small capitalism results from their movement into expanding, but highly competitive, industrial niches that are relatively unattractive to men. The authors find that these woman-owned businesses are concentrated within traditionally female-typed fields with lower average business receipts than male-typed fields. Moreover, even within the same industrial subcategories, women owners achieve less economic success than men owners. Although some of the immediate barriers faced by U.S. women in the small-business arena-such as lack of access to capital and government contracts-differ from those that confront women employees, the underlying causes are similar. The authors' discussion suggests that women in the United States carry their labor market disadvantage with them to the small-business sphere, where it is compounded by new manifestations of the same institutional barriers. Anthropocentric and individualistic foundations result in forest management policy based on linear, single?dimensional, marginal analysis detrimental to the well?being of the forest ecosystem. Recent theories from the fields of ethics, economics, and policy analysis find that nonlinear, multidimensional analysis is possible, provided one can divorce oneself from anthropocentric and individualistic tendencies. Deep policy is introduced as a policy perspective that encourages questioning the fundamental values upon which policy decisions are made, just as deep ecology encourages a similar questioning of ecological (...) values. An experiment is proposed for forest management in the Pacific Northwest, in which a self?realizing Forest Board demonstrates punctuated equilibrium in forest management policy. (shrink)

This article presents a selective review of recent design PhDs that identify and analyse the methodological innovation that is occurring in the field, in order to inform future provision of research training. Six recently completed design PhDs are used to highlight possible philosophical and practical models that can be adopted by future PhD students in design. Four characteristics were found in design PhD methodology: innovations in the format and structure of the thesis, a pick-and-mix approach to research design, situating (...) practice in the inquiry, and the validation of visual analysis. The article concludes by offering suggestions on how research training can be improved. By being aware of recent methodological innovations in the field, design educators will be better informed when developing resources for future design doctoral candidates and assisting supervision teams in developing a more informed and flexible approach to practice-based research. Things changed noticeably in the last couple of decades or so of that century, and now “evolutionary ethics”—which had lain dormant since Darwin’s contemporary Herbert Spencer—is a lively and hotly debated topic. We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the (...) class='Hi'>field. The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. Internet counseling is an area of rapid expansion in the field of applied psychology. Internet counseling or psychotherapy involves a variety of activities such as psychoeducation, individual therapy, and automated self-help interventions delivered via the Internet. Although other professional societies such as the National Association of Social Workers, the American Counseling Association, and the National Board of Certified Counselors have tackled the issues of Internet counseling ethics head on, the American Psychological Association has been conspicuously absent from this debate. Feminist educators and theorists are stretching the boundaries of what it means to do religion and science. They are also expanding the theoretical and practical frameworks through which we might present curricula in thosefields. In this paper, I reflect on the implications of feminist pedagogies for the interdisciplinary field of religion and science. I begin with a brief discussion of feminist approaches to education and the nature of the feminist classroom as a setting for action. Next, I present some (...) theoretical and practical issues to consider when developing a feminist praxis and an antisexist curriculum. This leads into a discussion of the role of language and critical reflection in the religion and science classroom, the risks associated with reflective discourse, and considerations in the use of ‘feminist’ teaching tools such as small group work, journals, and portfolio assessment. This paper examines the design and teaching of "Genocide and Human Rights," an innovative, higher education course introduced in 2002 to provide training for a new generation of scholars and teachers. The course was developed and funded by a small non-profit organization, the Zoryan Institute, in Toronto, Canada. One purpose of the course is to teach about the Armenian genocide within a comparative genocide and human rights framework. Another goal is to fill a gap in the curriculum in response to (...) increased student interest and research in genocide and human rights. The course serves as a valuable pedagogical model including its comparative framework, teaching by invited specialists, adjusting the curriculum to reflect student interest and new scholarship, and setting up and maintaining formal and informal scholarly networks. Features of critical pedagogy include classroom dialogue and critique and respect for differences in background and opinion. For example, interactions between students of Turkish and Armenian background provide an opportunity to explore issues of stereotypes, memory, denial and reconciliation. Few novelists in the twentieth century have escaped Joyce's influence one way or another, and Robert Martin Adams has even dedicated a book, AfterJoyce, 1 to the proposition that the history of prose fiction (...) is most properly divided into two eras, before and after Joyce. One suspects that Joyce would have appreciated Adams's quasi-blasphemous periodizing.My focus here is Joyce's influence on a different intellectual and cultural realm, philosophy. Joyce's impact on philosophy clearly has not been of the same magnitude. Joyce is not one of those rare figures who have spanned fields or been as important an influence in another field as in his own, unlike Nietzsche, say, or a figure of concern to us here, Jacques Derrida. Joyce's impact on philosophy, thus, is not epoch-changing or field-changing in the way his impact on literature is. Wittgenstein and Heidegger are the two philosophers in the twentieth century whose work have comparably been assessed as epoch-changing. It is worth noting that both men are close contemporaries of Joyce: Wittgenstein, in particular, with his multilingual, Austro-Hungarian, and pan-European character, orientation towards the arts, defiance of so many philosophical conventions, and self-awareness of language, offers a fascinating parallel with Joyce, a parallel already explored to [End Page 334] some extent in the literature. If Joyce, Stravinsky, Picasso, and Le Corbusier, for example, can be said to exemplify modernist literature, music, painting, and architecture, then Wittgenstein is the exemplification of modernist philosophy. But Modernism, or at least so we are told, is out of fashion and out of date, yet Joyce remains our contemporary in ways many of his fellow modernists may not. Nowhere is this more clearly shown than in his continuing presence in contemporary philosophy.The conventional way of writing the history of philosophy in the twentieth century is to divide it into two camps, one oriented towards mathematics, science and logical analysis, a school of philosophy called the analytic or Anglo-American school, the other oriented towards literature and culture and an engagement with the history of philosophy, called the Continental school. That there are a number of problems with this way of mapping the field is by now widely accepted, but no one has successfully replaced this division with anything generally seen to be more adequate, so we continue to use the terms, if as Derrida might say "under erasure." If contemporary analytic philosophy has a single leading figure, I would assign that position to Donald Davidson; continental philosophy has distinct German and French variants, but clearly foremost on the French side is Jacques Derrida. Like all fields of inquiry, Irish studies has its own traditions, its own ways of organizing information. even the most adventurous of the native practitioners tend carefully to maintain disciplinary boundaries when presenting evidence to sustain a thesis, and American scholars have used Irish practice as their frame of reference. This essay, which engages with the time-honored and increasingly vexed enterprise of defining “Irishness,” introduces play into these traditions both in spirit and in methodology. An alternative approach to analyzing Ireland (...) might foreground the underlying assumptions about social relations and historical patterns that link Irish art and writing across diverse fields of inquiry. Exploring the many rhetorics of Ireland might make it impossible, for example, for those involved in the essential task of historical and scientific inquiry—to overlook the submessages of popular Irish representations.I begin, obliquely, with a contrast between American and Irish censorship of music videos. My inquiry targets some fundamental differences between American and Irish appropriations of the body, from which the essay suggests symmetries between the psychological development of individuals in Ireland and one stage in what might be termed the psychohistory of Irish culture. Philosophers and psychologists discuss new collaborative work in moral philosophy that draws on evolutionary psychology, cognitive science, and neuroscience. For much of the twentieth century, philosophy and science went their separate ways. In moral philosophy, fear of the so-called naturalistic fallacy kept moral philosophers from incorporating developments in biology and psychology. Since the 1990s, however, many philosophers have drawn on recent advances in cognitive psychology, brain science, and evolutionary psychology to inform their work. This collaborative trend is especially strong in (...) moral philosophy, and these volumes bring together some of the most innovative work by both philosophers and psychologists in this emerging interdisciplinary field. The contributors to volume 1 discuss recent work on the evolution of moral beliefs, attitudes, and emotions. Each chapter includes an essay, comments on the essay by other scholars, and a reply by the author of the original essay. In his précis of a recent book, Richard Joyce writes, “My contention…is that…any epistemological benefit-of-the-doubt that might have been extended to moral beliefs…will be neutralized by the availability of an empirically confirmed moral genealogy that nowhere…presupposes their truth.” Such reasoning – falling under the heading “Genealogical Debunking Arguments” – is now commonplace. But how might “the availability of an empirically confirmed moral genealogy that nowhere… presupposes” the truth of our moral beliefs “neutralize” whatever “epistemological benefit-of-the-doubt that might have been (...) extended to” them? In this article, I argue that there appears to be no satisfactory answer to this question. The problem is quite general, applying to all arguments with the structure of Genealogical Debunking Arguments aimed at realism about a domain meeting two conditions. Chaosmosis and Subjectivity: The Aesthetics of Félix Guattari (1930-1992) is the first doctoral thesis monographically devoted to the work of this great contemporary thinker. The aim of this study is the analysis of his aesthetics in the context of French post-structuralist thought, by means of a systematic analysis of the influences, stages and foundations of his work. From a state of the field which allows us to understand the historiographical keys in the reception of his thought, we then present (...) the development of the complete Guattarian works, paying special attention to all the historical correlates, in order to thus picture the post-Lacanian Guattari who writes about machinic production, collective enunciation, micropolitics and ecosophy. Next, we address the groundings of Guattarian aesthetic thought in relation to four problem-authors: Joyce, in relation to Guattari’s overwhelming volonté d’écriture; Proust, peak of Guattari’s analytic ambitions, and an opportunity to talk about the phylum machinique in the context of his theory of a nonindividualized enunciation; Kafka, the minor, and collective enunciation; and finally, Schumann, paradigmatic example of the great importance music had in Guattari’s work and life, and suitable viewpoint for a deep theory of the refrain. Ultimately, what this study tries to point out is the centrality of the aesthetic plane in Félix Guattari’s work, just as the profound richness of Guattarian contribution to Contemporary Aesthetics. Meanwhile, 'Cinders,' who had been doing the chores for (...) centuries, has been magically transformed in recent times, decked out in new clothes by Richard Holmes, Claire Tomalin, Juliet Barker, Peter Ackroyd et al., and, as the millennium approached, celebrated and admired on all sides. At the start of the new century, literary biography remains in vogue. The bibliography that carries it forward is rolling, and there is no sign of it turning into a pumpkin. Why is Cinderella so popular?One obvious if superficial answer might be that literary biography is where literary people go who find the contemporary preoccupation with theory to be personally undernourishing and critically unenlightening; they would rather stay with the literary works themselves and with the lives, the minds, and the times that produced them. Yet it is not only literary biography that is thriving; life writing in general is the fastest-growing area of mainstream publishing, evidence for which can be seen in Waterstone's flagship store in London's Piccadilly, which devotes its prime ground-floor site to thousands of biographies. This commercial high profile is responding to an evident, if unfocused, need to look at other lives and understand them. Individual reasons for the popularity of biography range from prurient interest and hero worship to a, perhaps unrecognized, search for coherence and purpose in an age that is often disinclined either to accept institutional values or to respect traditional authority. The motives for this search usually include the desire for recognizable success, to which end the invention of a convincing identity is essential. Biographies offer models of how others live, face challenges, and cope with change; they are prime sites for studying ourselves. Curiously, this justification for biography as providing [End Page 44] a model for living was felt most strongly when this literary genre first emerged in the eighteenth century. The difference today is that the model has changed: Biography as a moral exemplum based upon Christian principles has been replaced in today's celebrity culture by the demand for models of success provided by public personalities. Nonetheless, whatever the range of satisfactions readers seek in biography, life writing offers, in one form or another, detailed pictures of widely different ways of living and amid these, perhaps, some clues to how an individual sense of identity might be shaped.Literary biographies (i.e., biographies of writers, not biographies with a particular literary quality) are a significant and, in some respects, a unique subgenre since they purport to offer access to the creative imagination. This book argues that a radical political gesture can be found in Søren Kierkegaard’s writings. The chapters navigate an interdisciplinary landscape by placing Kierkegaard’s passionate thought in conversation with the writings of Georg Lukács, Carl Schmitt, Walter Benjamin and Theodor Adorno. At the heart of the book’s argument is the concept of “indirect politics,” which names a negative space between methods, concepts, and intellectual acts in the work of Kierkegaard, as well as marking the dynamic relations between Kierkegaard and the (...) aforementioned thinkers. Kierkegaard’s indirect politics is a set of masks that displaces identities from one field to the next: theology masks politics; law masks theology; political theory masks philosophy; and psychology masks literary approaches to truth. As reflected in Lukács, Schmitt, Benjamin, and Adorno, this book examines how Kierkegaard’s indirect politics sets into relief three significant motifs: intellectual non-conformism, indirect communication in and through ambiguous identities, and negative dialectics. Bartholomew Ryan is currently a postdoctoral fellow (2011- ) at the Instituto de Filosofia da Nova, New University of Lisbon, Portugal. The paper scrutinizes the literary output of George Moore with reference to the expectations of the new generation of Irish writers emerging at the beginning of the twentieth century. Although George Moore is considered to belong to the Anglo-Irish ascendancy writers, he began his writing career from dissociating himself from the literary achievements of his own social class. His infatuation with the ideals of the Gaelic League not only brought him back to Dublin, but also encouraged him to write short (...) stories analogous to famous Ivan Turgenev’s The Sportsman’s Sketches. The idea of using a Russian writer as a role model went along with the Gaelic League advocating the reading of non-English European literature in search for inspiration. However the poet’s involvement in the public cause did not last long. His critical view on Ireland together with his uncompromising approach towards literature resulted in a final disillusionment with the movement. The paper focuses on this particular period of Moore’s life in order to show how this seemingly unfruitful cooperation became essential for the development of Irish literature in the twentieth century. The Untilled Field, though not translated into Irish, still marks the beginning of a new genre into Irish literature—a short story. More importantly, the collection served as a source of inspiration for Joyce’s Dubliners. These and other aspects of Moore’s literary life are supposed to draw attention to the complexity of the writer’s literary output and his underplayed role in the construction of the literary Irish identity. In recent years, Richard Kearney has emerged as a leading figure in the field of continental philosophy, widely recognized for his work in the areas of philosophical and religious hermeneutics, theory and practice of the imagination, and political thought. This much-anticipated--and long overdue--study is the first to reflect the full range and impact of Kearney's extensive contributions to contemporary philosophy. This article investigates the complex object of the political book. Mobilising Deleuze and Guattari's typology of the book, the article assesses the material properties of four specific books (or sets of books): Mao Zedong's ‘Little Red Book’, Russian Futurist books, Antonin Artaud's paper ‘spells’, and Guy Debord and Asger Jorn's ‘anti-book’ Mémoires. Highly critical of the dominant mode of the political book, what they call the ‘root-book’, Deleuze and Guattari draw attention to the troubling religious structures and passions that order (...) its field. Here the book internalises the world as the origin and source of truth and authority – a mode of existence as dear to the avant-garde as it is to religious formations: ‘Wagner, Mallarmé, and Joyce, Marx and Freud: still Bibles.’ But the book also features in Deleuze and Guattari's counter-figure of the ‘rhizome-book’, where they foreground the dynamic materiality of this medium: ‘A book has neither object nor subject; it is made of variously formed matters, and very different dates and speeds.’ The rhizome-book is an enticing concept for assessing the political book, yet Deleuze and Guattari pay little attention to the specific, concrete attributes of this medium. In focusing on the properties of particular books this article seeks to address that absence, and so contribute to an understanding of the political book that is fully engaged with its material forms. In this article I am proposing a post‐structuralist treatment of some concepts central to a pedagogical agenda. These are concepts of territorial implications, such as democracy, nationality, patriotism and the foreign, concepts closely linked to The Enlightenment and to education. I am proposing this because these might be the times, for academics in the field of education, to revitalise reflections around such concepts in order to question the legitimisation and motivations for our actions on new grounds. A deconstruction of (...) the opposition between duty and pleasure, and a possible necessary parricide is suggested in order to question hegemonic ideologies and overcome what might be described as an academic paralysis. This essay focuses on the phenomenon of synesthesia. In an attempt to differentiate between genuine synesthesia and metaphorical synesthesia, I have searched for shared traits among synesthetic visual artists, as well as among composers and performing musicians. The field of synesthesia has been rife with misunderstandings. Though ever increasing numbers of exhibitions, books, and articles have used the title or subtitle, “Synesthesia in art and/or music”, few of these adequately define synesthesia. The major cause of the problem is that (...) art and music historians and curators, as well as artists and composers themselves, have confused the desire to intermingle various art forms with the phenomenon of genuine synesthesia. I show the existence of recurrent patterns of artistic response to synesthetic experience, the evidence of shared characteristics, by taking the examples of Carol Steen, Marcia Smilack, Joan Mitchell, David Hockney, Messiaen. I also present the results of my investigation on the synesthetic perceptions of the pianist Joyce Yang. Cet essai porte sur le phénomène de la synesthésie. Pour bien différencier synesthésie authentique et synesthésie métaphorique, j’ai recherché des traits communs chez les artistes visuels synesthètes, ainsi que chez les compositeurs et les musiciens interprètes. Le champ de la synesthésie a été envahi par des malentendus. Bien que de plus en plus d’expositions, de livres et d’articles utilisent le titre ou le sous-titre « Synesthésie dans l’art et/ou la musique », peu d’entre eux définissent adéquatement la synesthésie. La principale cause du problème est que les historiens et les conservateurs d’art et de musique, ainsi que les artistes et les compositeurs eux-mêmes, ont confondu le désir d’entremêler diverses formes d’art avec le phénomène de la véritable synesthésie. This reading companion and commentary on Lacan Seminar XXIII provides detailed analyses of Lacan's seminar while maintaining an overall continuity and consistency. This book does not purport to provide an exhaustive and systematic line-by-line reading of a very complex and varied seminar. Rather it selects key themes of Lacanian theory that are found present throughout his work. In addition, the book does not try to simplify Lacan's ambiguous style, leaving the text open to different interpretations, while providing theory, commentary, and (...) lines of analysis into some of Lacan's important insights. Finally, this book is not about Joyce the writer, but more about the use that Lacan makes of Joyce. I have three aims in this essay. I want to offer an example of an interdisciplinary historical inquiry combining literary criticism with the relatively new field of critical legal studies. I intend to use this historical inquiry to argue that the ambiguity of literary texts might better be understood in terms of an era’s social contradictions rather than in terms of the inherent qualities of literary language or rhetoric and, conversely, that a text’s ambiguity can help us expose the (...) contradictions masked by an era’s dominant ideology. I try to prove my assertion by applying my method to Herman Melville’s three most famous short works—“Benito Cereno,” “Bartleby, the Scrivener,” and Bill Budd, Sailor—works dealing with the law and lawyers and widely acknowledged as ambiguous.1 I will base my critical inquiry into these stories on Melville’s relationship with his father-in-law, Lemuel Shaw, who, while sitting as the chief justice of the Supreme Judicial Court of Massachusetts from 1830 to 1860, wrote some of the most important opinions in what Roscoe Pound has called “the formative era of American law.”2Before I get started, I should clarify what this study does not entail. By using Shaw and his legal decisions in conjunction with Melville’s fiction, I am not conducting a positivistic influence study. My method will not depend on the positivist assumption that Shaw’s legal opinions can be used to illuminate Melville’s texts only when his direct knowledge of Shaw’s opinions can be proved. Nor will I limit myself to a traditional psychoanalytic reading: my emphasis is on political and social issues, and too often these issues are deflected by translating them into psychological ones. At the same time, I recognize that critics concerned with political and social issues too often neglect questions raised by a writer’s individual situation. I compare Shaw to Melville not to reduce Melville’s politics to psychology but to prevent a political study from neglecting the political implications of psychology, to remind us—as the title of Fredric Jameson’s book The Political Unconscious reminds us—that psychological questions always have political implications. 1.
